Kalona Man Convicted for Tax Offenses
DAVENPORT, IA – On May 7, 2012, James Lavon Miller, age 62, of Kalona, IA, was convicted on four counts of making false claims to the United States Internal Revenue Service, announced United States Attorney Nicholas A. Klinefeldt. Miller waived his right to a jury trial and was tried before United States District Judge John A. Jarvey.
Miller’s conviction stems from tax returns that he filed in 2008 and 2009 corresponding to the 2005, 2006, 2007, and 2008 tax years. Miller knowingly listed false amounts of interest income and federal withholding in his returns and claimed millions of dollars of tax refunds to which he was not entitled. Miller will be held in custody pending his sentencing. His sentencing date has not yet been set.
The case was investigated by the Criminal Investigation Division of the Internal Revenue Service, and was prosecuted by the United States Attorney’s Office for the Southern District of Iowa.
